Labour's Big Whip Round illegal

Labour announced the Big Whip Round when they got their hand well and truly caught in the till. They still haven’t paid a cent back.

Now over at Sir Humphrey’s LBJ has a legal opinion that the Big Whip Round is actually illegal.

Where any person knowingly provides money for any purpose which is contrary to the provisions of this Act, or for any election expenses incurred in excess of the maximum amount allowed by this Act, or for repaying any money expended in any such payment or expenses, that person is guilty of an illegal practice.

Now, some bits of that are a little extraneous – let’s make it a little clearer:

Where any person knowingly provides money … for repaying any money expended in any … payment or expenses [incurred in excess of the maximum amount allowed by the Electoral Act] that person is guilty of an illegal practice.

And even more clearly:

Give money to the big whip round, and know that that money is to repay Parliamentary Services for a pledge card that pushed the Labour Party over the campaign spending limit and you can be fined $3000.
